The second amendment of the US Constitution
“A well-regulated Militia, being necessary to
the security of a free State, the right of the people to keep and bear Arms,
shall not be infringed.”
Why was the 2nd amendment written?
The Second Amendment, ratified in 1791, was proposed by
James Madison to allow the creation of civilian forces that could counteract a
tyrannical federal government.
Modern debates about the Second Amendment have focused on
whether it protects a private right of individuals to keep and bear arms or a privilege
that can be exercised only through militia organizations like the National
Guard.
Many in the Founding generation believed that governments were
prone to use soldiers to oppress the people. English history suggested that
this risk could be controlled by permitting the government to raise armies
(consisting of full-time paid troops) only when needed to fight foreign adversaries.
For other purposes, such as responding to sudden invasions or other
emergencies, the government could rely on a militia that consisted of ordinary
civilians who supplied their own weapons and received some part-time, unpaid
military training.
I don’t think the gun issue that is plaguing our modern society
has ever crossed the minds of our country’s founders. I don’t think James
Madison would have approved of non-militia members walking around with military-grade
firearms due to either psychological insecurities or, worse being inflicted
with some sort of mental illness.
Nothing in the US constitution prevents the US government
from banning military-grade assault weapons from being owned by ordinary
citizens. America, after all, is the only developed nation with the highest
murder rate due to the legalization of firearms.
